The Hidden Asset in Healthcare Legal Cases: Why Every Nurse deserves An Administrative Expert and or Consultant

Navigating the complex intersection of healthcare and law requires in my opinion more than just legal expertise. It demands a deep understanding of medical practices, nursing workflows, and the intricate regulations governing the healthcare industry. This is where an administrative expert and or consultant with a background in nursing and legal nurse consulting becomes invaluable.

My Journey: From Nursing to Legal Nurse

My professional journey began as a nurse, where I honed my skills in patient care at the bedside in critical care for over 2 decades.  Transitioning into the role of a investigator taking national training, I gained insights into the legal challenges faced by healthcare professionals when under investigation by a licensing board. This  brief but enlightening stint as an investigator provided me with additional training and a unique perspective on agency operations and regulatory processes. This dual experience allows me to bridge the knowledge gap between rules and regulations and standards of nursing care, offering a perspective that attorneys find priceless.

Case Review: The Importance of Accurate Medical Records

One of the most critical aspects of healthcare legal cases is the accuracy and completeness of medical records. In a recent case, I was asked to review the documentation provided. It became evident that the correct medical records had not been sent—a detail that had gone unnoticed by the legal team. By working closely with the attorney and their nurse client, I helped draft a comprehensive response to the board’s allegations, ensuring all relevant information was included. My understanding of nursing workflows and the nuances of medical documentation proved essential in this process.

Uncovering Critical Insights: The Value of a Nursing Perspective

In another case, my involvement led to a pivotal breakthrough. The board’s investigation had been conducted by individuals who were not nurses, and no nurse had reviewed the case and there was no nursing negligence. This oversight meant that crucial nursing perspectives were missing. I compiled a detailed 10-page report for the legal team highlighting these gaps, prompting the board’s attorneys to have a nurse review the case. The result? Allegations were removed, and the case was dropped. This outcome underscores the vital importance of having nursing experts involved in the review process of even administrative cases.

Proven Results: My involvement has repeatedly led to crucial re-evaluations of cases, often resulting in significantly altered outcomes, including the removal of allegations.
